Privacy Statement

Abú Media Teoranta (Abú / we / us /our) is committed to protecting the privacy of all personal information about individuals that we collect and process. This statement sets out how any personal information we collect from and about you will be processed by us.

 

We collect information through our website and application form: 

  1. We collect the following information about visitors to our website via Google Analytics and Facebook Pixels:
  •  The number of visitors to our website
  • The online pathway they have followed to reach our website (e.g. through Facebook or otherwise)
  • The type of digital device a visitor has used from which to access our website. 

 

We do not collect IP addresses or any identifying user information about visitors to our website. 

 

We collect personal information (“Data”) provided to us by individuals (“Applicants”) who wish to apply to be considered as contributors to television, film and other audio-visual productions (“Productions”) produced by Abú Media Teo.

 

The specific and lawful purposes (“Purposes”) for which we collect and process Applicant Data are:

  • for consideration of Applicants’ applications to be contributors to specific Productions;
  • for producing and exploiting those Productions in the legitimate interests of our business.

Data is held on our servers at Hosting Ireland on our behalf and is processed by Abú exclusively in a manner directed by us and not otherwise. We have satisfied ourselves that the collection and processing of Data by Abú protects the privacy of that data in compliance with the General Data Protection Regulation 2018 (GDPR). 

Data is held by us and we retain copies in both paper and electronic format on our own server in order to process Data for the Purposes and for no other purpose.

2.2   We do not disclose Data to any third-party, other than as follows:

  • On a strictly occasional and need-to-know basis only to any co-producers, commissioning broadcasters, other financiers of Productions and our professional advisors for the legitimate purposes of our business and we do so only where those third-parties have agreed to protect the privacy of that information to a level consistent with the requirements of the GDPR;
  • to third-party IT and file-sharing service providers and contractors, including service providers and contractors outside the EU, whose services we use for the legitimate purposes of our business and subject always to the agreement of those third-parties to protect the privacy of that information to a level consistent with the requirements of the GDPR;
  • where Applicants have voluntarily disclosed that information either on camera for a Production and / or on publicly available outlets including without limitation social media or by way of newspaper, television or radio interviews; and / or 
  • pursuant to any legal obligation or entitlement we may have to disclose that information. 

 

  1. Data Security

We use appropriate technological and physical security measures to keep the Data secure at all times while it is being processed by us. We engage in staff training and awareness of data protection. We review our data security policies and procedures regularly. Unfortunately, transmission of data via the internet can never be guaranteed to be completely secure. Any communication of Data you make to us, whether through a third party or directly with Abú is at your own risk in this respect. 

  1. Data Retention

We retain the Data for no longer than is necessary for the Purposes, to include any post-transmission evaluations, complaints-handling and legal claims. Where you indicate explicitly on any application form for a Production that we may retain the Data for consideration of your possible contribution to future Productions, other than the Production in respect of which you originally provided us with the Data, we will do so subject always to your entitlement at any time to ask us to erase the Data. 

  1. Your rights

You have the right at any time to;

  • ask us to rectify any inaccuracies or omissions in any Data we hold about you;
  • ask us to erase any Data we hold about you;
  • ask us whether we process any Data about you, to provide you with details of our processing of that Data and to provide you with a copy of that Data ;
  • withdraw your consent to our processing of any Data we hold about you;
  • ask us to restrict our processing of any Data we hold about you where circumstances of restriction laid down by GDPR apply;
  • make a complaint to the Data Protection Commissioner about our processing of any Data we hold about you.

We are not responsible for the contents or functioning of any websites to which our website is linked. You visit and use the facilities provided by other websites at your own risk. This Privacy Statement applies only to the websites controlled by Abú Media Teo.

  1. Updates to Privacy Statement

We may update this Privacy Statement from time to time to reflect any changes in technology, legislation or our data processing practices which may affect the way in which we process your personal information.

 

Acceptable Use Agreement

1.               ACCEPTABLE USE Agreement

1.1.           Except as expressly permitted by any local law, you hereby warrant and undertakes not to:

1.1.1.      use the Services for any unlawful or illegal purpose, act dishonestly, fraudulently or unprofessionally by engaging in unprofessional behaviour by posting inappropriate, inaccurate, or objectionable content to or through the Supplier Platform;

1.1.2.      input personal or special categories of personal data (as defined under the GDPR) relating to an Applicant without explaining the purpose of the collection and processing of such data to the data subject;

1.1.3.      make any temporary or permanent reproduction by any means and in any form, in whole or in part, of the permanent aspects of the Supplier Platform;

1.1.4.      make any translation, adaptation, arrangement or any other alteration of the permanent aspects of the Supplier Platform;

1.1.5.      make any form of distribution to the public of the content of the Supplier IP, in whole or in part, or of copies thereof;

1.1.6.      remove or alter any copyright or other proprietary notice from any part of the Supplier IP;

1.1.7.      disseminate, sell, give away, hire, lease, offer or expose for sale or distribute the Supplier Platform, or another product wholly or partially derived from any of the foregoing;

1.1.8.      create a user account for anyone other than a natural person;

1.1.9.      input personal data relating to any individual illegally;

1.1.10.   harass, abuse or harm another person, including sending unwelcomed communications to others using the Supplier Platform;

1.1.11.   use or attempt to use another's account or create a false identity using the Supplier Platform;

1.1.12.   participate, directly or indirectly, in the setting up or development of a network that seeks to implement practices that are similar to sales by network or the recruitment of independent home salespeople for the purposes of creating a pyramid scheme or other similar practices;

1.1.13.   use manual or automated software, devices, scripts robots, other means or processes to access, “scrape,” “crawl” or “spider” any web pages or any part of the Supplier Platform;

1.1.14.   use bots or other automated methods to access the Supplier Platform, add or download contacts, send or redirect messages, or perform other activities through the Supplier Platform, unless explicitly permitted by the Supplier;

1.1.15.   engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Supplier Platform or any website from which the Supplier Platform is provided;

1.1.16.   attempt to or actually override any security component included in or underlying the Supplier Platform;

1.1.17.   engage in any action that directly or indirectly interferes with the proper working of or places an unreasonable load on the Supplier’s infrastructure, including, but not limited to, sending unsolicited communications to other users or Supplier personnel, attempting to gain unauthorised access to the Supplier Platform, or transmitting or activating computer viruses through or on the Supplier Platform; or

1.1.18.   upload, post, email, transmit or otherwise make available or initiate any content that:

         i.     falsely states, impersonates or otherwise misrepresents your identity, including but not limited to the use of a pseudonym;

        ii.     is unlawful, libellous, abusive, obscene, discriminatory or otherwise objectionable;

        iii.     includes information that you do not have the right to disclose, use or make available under any law or under contractual or fiduciary relationships;

        iv.     infringes upon patents, trademarks, trade secrets, copyrights or other proprietary rights;

        v.     includes any unsolicited or unauthorised communication, advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation and/or infringes upon the rights of individuals under applicable data protection laws where the Services are used.
